The nation's largest tobacco firm, Philip Morris USA, filed suit in Federal court, arguing that the city of San Francisco, CA, has unconstitutionally banned pharmacies from selling tobacco products. Public health officials argue that the Constitution's First Amendment right of free expression was never intended to apply to the sale of tobacco products.
